Terms and Conditions of Sale

Article 1 – Purpose

These terms and conditions govern sales by L.P.S., a simplified joint-stock company (S.A.S.U.) with a capital of €100, registered with the Nanterre Trade and Companies Register under number 895 377 331.

Article 2 – Price

The prices of our products are listed in euros, inclusive of all taxes (VAT and other applicable taxes as of the date of the order), unless otherwise specified, and exclude processing and shipping fees. For orders shipped to a country other than mainland France, you are the importer of the product(s) in question. Customs duties, other local taxes, import duties, or state taxes may be applicable. These duties and fees are not the responsibility of the company. Manager. You are responsible for these costs and bear full responsibility for them, both in terms of reporting and payments to the relevant authorities and agencies in your country. We recommend that you consult your local authorities regarding these matters. All orders, regardless of their origin, are payable in euros. The company Manager reserves the right to change its prices at any time, but the product will be billed based on the price in effect at the time the order is confirmed, subject to availability. The products remain the property of the company Manager until full payment has been made. Please note: As soon as you take physical possession of the products you ordered, the risk of loss or damage to the products is transferred to you.

Article 3 – ORDER REGISTRATION AND CONFIRMATION

3.1 Navigating the Site

Users can view the various Products offered for sale by https://www.reef-parfum.com/ on its Website.
Users may freely browse the various pages of the Site without being obligated to place an order.

3.2 Order Registration

If the User wishes to place an order, they will select the various Products they are interested in and indicate that interest by clicking on the «shopping cart» icon.
At any time, the User may:

  • view a summary of the products they have selected by clicking on the shopping cart.
  • Continue or change your selection of products by clicking “Continue Shopping.”.
  • Complete your product selection and order these products by clicking “Proceed to Checkout.”.

To order the Products they have selected, after clicking “Proceed to Checkout,” each User must log in by entering their email address and the password they previously chose when creating their account, or, if this is their first order, by clicking «Create an Account.» In the latter case, the User must accurately complete the form provided, including the information necessary for identification, such as their last name, first name, and mailing address. In addition, the User must provide an email address and a password of their choice, which will be personal and confidential and which they will need to log in to the Site in the future.
The User is informed and agrees that entering these two identifiers constitutes proof of his or her identity and indicates his or her consent.
Once the User has logged in, they must confirm the shipping address, after which an order form will appear on the screen, summarizing: the type, quantity, and price of the Products selected by the User, as well as the total order amount, shipping costs, delivery time, the User’s contact information, and the delivery address for the Products.

Sales Offers

To take advantage of a promotional offer sent to them, Users must enter and confirm their ”promo code“ in the designated field on the checkout page.

3.3 Final Order Confirmation and Payment

After reviewing the status of their order, and once the User has provided all the requested information, a summary of this information and the order will appear, and the User must select the payment method they wish to use to finalize their order.
Orders are payable by:

  • euros via French or international credit card.

Please note that when making an immediate payment by credit card, the transaction is secured using SSL (Secure Socket Layer) to protect all payment-related data, and that at no time will the User’s banking information be transmitted through the https://www.reef-parfum.com/ computer system.
As soon as the User confirms payment, the order is registered. The User becomes a Customer. The order form will be stored in https://www.reef-parfum.com/’s computer records and will be considered proof of the contractual relationship between the Parties.
The Customer has the right to cancel the order and receive a refund within fourteen (14) business days from the date the Customer receives the Products.

3.4 Order Confirmation

An order summary will appear once the order has been confirmed.
This confirmation will include all the essential elements of the contract entered into between the Parties.
This order summary will also be emailed to the Customer within minutes of the purchase.
The Customer can then access “Order Tracking” by clicking “Log In” and entering their email address and password.

3.5 Modifying an Order

You can track your orders from the «Log In» menu.
To modify an order, you must cancel it, add it back to your cart, and then make the desired changes before confirming it.
An order can only be modified or canceled when its status is «Registered.».
An order with a status of «being prepared» or «shipped» can no longer be modified.

Article 4 – Payment

By confirming your order, you agree to pay the price listed. Payment for your purchases is made by credit card through our secure system. Your card will not be charged until the order is shipped. In the case of split shipments, only the products that have been shipped will be charged.

Article 5 – RETURNS – REFUNDS AND RIGHT OF WITHDRAWAL

Right of Withdrawal

The Customer has a thirty (30)-day return period starting from the date of receipt of the entire order to cancel the purchase without having to provide a reason.
To exercise the right of withdrawal, the customer must notify the seller of their decision to cancel their order by means of an unambiguous statement specifying their first and last name, email address, mailing address, order number, and order date:

Refunds & Product Returns
  1. In the event of a cancellation by the Customer, L.P.S. will refund the payments received from the Customer without undue delay and, in any event, no later than fourteen (14) days from the date on which L.P.S. is notified of the Customer’s decision to cancel.
  2. If the Customer cancels the entire order, L.P.S. will refund all payments received from the Customer for that order.
  3. If the Customer cancels part of the order, L.P.S. will refund the amount for the returned Products.
  4. The refund will be issued via the same payment method the Customer used for their order or by bank transfer.
  5. L.P.S. may delay this refund until the Products have been received and inspected.

We accept returns of both defective and non-defective products. Only new, unused products may be returned. The customer is responsible for return shipping costs. Refunds are issued 48 hours after we receive and inspect the package.

The Customer is responsible for the costs of returning the entire order or the Products.

Article 6 – Delivery

Products are delivered to the shipping address provided during the ordering process, within the timeframe indicated on the order confirmation page. In the event of a shipping delay, you will receive an email informing you of any potential impact on the delivery timeframe that was originally provided to you. In accordance with legal provisions, in the event of a delivery delay, you have the option to cancel the order under the terms and conditions set forth in Article L 138-2 of the French Consumer Code. If you receive the product in the meantime, we will refund the purchase price and shipping costs in accordance with the terms of Article L 138-3 of the French Consumer Code. For deliveries made by a carrier, the company Manager cannot be held liable for delivery delays caused solely by the customer's unavailability after several attempts to schedule a delivery time.

Article 7 – Warranty

All our products are covered by the legal warranty of conformity and the warranty against hidden defects, as provided for in Articles 1641 et seq. of the Civil Code. If a product sold does not conform to its description, it may be returned, exchanged, or refunded. All complaints, requests for exchanges, or refund requests must be made within 30 days of delivery. Products must be returned to us in the condition in which you received them, including all components (accessories, packaging, instructions, etc.). Shipping costs will be reimbursed based on the invoiced rate, and return shipping costs will be reimbursed upon presentation of supporting documentation. The provisions of this Article do not preclude you from exercising the right of withdrawal provided for in Article 6.

Article 8 – Liability

The products offered comply with current French law. The company's liability Manager shall not be held liable in the event of non-compliance with the laws of the country where the product is delivered. It is your responsibility to check with local authorities regarding the importation or use of the products or services you intend to order. Furthermore, the company Manager cannot be held liable for any damages resulting from misuse of the purchased product. Finally, the company’s liability Manager shall not be held liable for any inconvenience or damage arising from the use of the Internet, including, but not limited to, service interruptions, unauthorized access, or the presence of computer viruses.

Article 9 – Governing Law in the Event of Disputes

The language of this contract is French. These terms and conditions of sale are governed by French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.

Article 10 – Intellectual Property

All elements of the https://www.reef-parfum.com/ website are and remain the exclusive intellectual property of the company Manager. No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever—even in part—any elements of the site, whether software, visual, or audio. Any simple or hypertext link is strictly prohibited without the company’s express written consent Manager. Article 13 – Personal Data The company Manager reserves the right to collect personal information and data about you. This information is necessary for processing your order, as well as for improving the services and information we provide to you. This information may also be shared with companies that support these business relationships, such as those responsible for fulfilling services and orders for their management, execution, processing, and payment. This information and data are also retained for security purposes and to comply with legal and regulatory obligations. In accordance with the law of January 6, 1978, you have the right to access, correct, and object to the personal information and data concerning you, directly on the website.

Article 11 – Archiving of Evidence

The Company Manager shall file purchase orders and invoices on a reliable and durable medium that constitutes a true and accurate copy in accordance with the provisions of Article 1348 of the Civil Code. The company’s electronic records Manager shall be considered by all parties concerned as proof of communications, orders, payments, and transactions between the parties.
